A formerly homeless heroin user who stole four bottles of wine from a supermarket has been handed a community order – on top of one he already had.

Robert Mossakowski, 31, admitted taking the drink from Asda in London Road, Kingston, on July 8.

The court heard Mossakowski, of Amberley Gardens, Epsom, was already keeping his appointments under a drug rehabilitation order.

He was given a 12-month supervision order at Lavender Hill Magistrates’ Court on Tuesday and ordered to pay a £60 surcharge.

Heather Chalk, defending, told magistrates: “It may not surprise you to learn that Mr Mossakowski has had an issue with both drug and alcohol misuse for a significant period of time.

“He has spent a large portion of recent years homeless or moving between temporary addresses.”

Mossakowski was finding his drug rehabilitation order “enormously helpful”, she said.

Magistrate Ms A Linton said: “Because of your previous offences of a similar nature, we think that it is appropriate to impose another community order.

“We have noted your early guilty plea, the fact that you made full admissions, and that the goods were recovered.”

She added: “I hope the good progress continues.”

Charles Taylor-Sonko, prosecuting, said security guards at Asda recognised Mossakowski and tracked him on CCTV.

He was seen to take the bottles, worth £44, and put them in a bag before trying to leave.

But he escaped from guards while they were waiting for police and he was arrested on July 19.

Speaking through a Polish interpreter, Mossakowsi thanked the magistrates for their time.
