Horses nicknamed the Chantilly Fillies are set to be evicted by the Government.
The Department of Health (DoH) has issued what is in effect an eviction notice to a trio of horses currently living on disused land along Chantilly Way, Epsom.
The notices, which were first erected in September and recently reissued, said failure to comply could result in the horses being impounded.
Residents have raised concerns since the first horse, nicknamed Chantilly Filly, appeared in the field after the Epsom Derby in 2012.
A DoH spokesman said another notice went up recently but it was understood that notices had previously been removed.
He said: "We are taking action to secure the removal of the horses.
"We are hoping to ensure that persons unnamed remove the horses and if not we will consider other options such as impounding or transport for sale."
If the notices are ignored, he said the DoH proposed to take legal action to obtain order for possession of the land.
The area was formerly part of the Epsom Cluster of psychiatric hospitals and it was retained by the government to allow the construction of Chantilly Way.
The RSPCA has always maintained its officers cannot remove the horses just because they are on their own and without shelter.
A RSPCA spokeswoman said: "We are aware with ongoing concern with the horses and have been monitoring them to ensure their welfare is being looked after for some time."
